Ministry of Labour warns firms against cheating workers
According to Qaseem Jameel, Deputy Director of the Inspection Department at the MoL, “If an employee works on official holidays like Eid Al Adha and the day payment is Dh100, the firm should pay the worker Dh150, in addition to the overtime,” added Jameel.
Moreover, workers have the right to take compensatory off in lieu of extra work on official holidays, he said, adding that the same rule applied to all the expatriates living in the country as there is no discrimation on religious grounds.

Confusion over rules for NOC requirement
Dubai: Ambiguity prevails on the rules for issuing the No Objection Certificate (NOC) when changing sponsors, say public relations officers.
It seems that there is a new rule at the Ministry of Labour everyday and no clear mechanism is in place on how to implement it, said Eyad Nassif, Public Relations Officer (PRO) at Fujairah National Construction.
"We as PROs are lost when it comes to these new decisions, especially with regard to the NOC rule as there is a lot of confusion on what is required. There should be a reference point at the ministry that provides us with the necessary information but it is simply not there," said Nassif.

Work ban for leaving job 'is unfair
Abu Dhabi:
The UAE Human Rights Organisation has urged the Labour Ministry to scrap the six-month work ban on employees who quit jobs after fulfilling their labour contracts, calling the practice 'unfair'.
The Ministry of Labour imposes a six-month work ban automatically along with the cancellation of the labour card, regardless of the number of years a person serves in a company.
"The six month ban is not a fair practice. If a worker completes his contract period then why should there be a ban on him? Should he not be allowed to look for better prospects? The current system allows employers to abuse the workers," said Farooq Mohammad, Chairman of the Labour and Naturalisation and Residency Committee of the Emirates Human Rights Association (EHRA).

Change in rules to change jobs
Humaid Bin Deemas, Assistant Undersecretary at the ministry, told Gulf News that earlier an exemption from the minister was needed in order to be able to transfer sponsorship before completing one year.
"However, since two weeks exemptions are no longer needed but the NOC from the previous sponsor is still a prerequisite and the applicant will have to pay a fee of Dh500 for each month remaining to complete this mandatory period. The procedure could be done at the customer service counter at the ministry and applicants no longer need to approach the minister's office," said Bin Deemas.

Obtaining a work permit
Dubai: The UAE labour law and the residency regulations for expatriates are almost the same in the seven emirates.
If you are planning to come here and work you need to obtain a work permit and should be sponsored by a company which must be licensed and registered with the Ministry of Labour.
If you are planning to invest here by setting up a company in partnership, you will be sponsored by a government department and your residency visa will be under the responsibility of the residency department of the emirate.

Transferring sponsorship
A woman who wishes to transfer her sponsorship from a company to her husband, has to apply for a new entry visa.
If an employee wishes to change his or her job, the person needs to change sponsorship and follow the requirements of the Ministry of Labour. If approved, then the naturalisation and residency department will issue a new residency visa for the applicant.

COLOMBO: Sri Lanka will sign several Memoranda of Understanding with the Governments of Jordan and Kuwait this week which will enhance the protection and the safety of Sri Lankan migrant workers living in these two countries.
Foreign Employment Promotion and Welfare Minister Keheliya Rambukwella said the signing of the MoUs will take place parallel to President Mahinda Rajapaksa’s visit to the two countries.
The first MoU will be signed between Rambukwella and Jordanian Labour Minister Bassir Al Kalam tomorrow.
“It is expected to improve the conditions of the Sri Lankan migrant workers several fold considering the early MoU signed between the two countries in 2006,” Rambukwella said.
“The workers will get a compulsory Insurance scheme under the new MoU. It will help them to obtain their salaries on time without unnecessary delays being forced on them.

UAE : Employer cannot deduct visa fees from salary
Obaid Rashid Al Zahmi, Assistant Undersecretary at the ministry, told Gulf News that visa charges should be paid only by the employer. "It's against the labour law to deduct money from the employee for any charges," he said.
The Labour Law, he said, states that no amount of money may be deducted from a worker's remuneration in respect of private claims except in recovery of advances paid to the worker in excess of his entitlements, contribution towards social security, insurance and welfare schemes, fines imposed for any offence and any debt payable in execution of a court ruling.

Dubai : Revised labour law released
Human Rights Watch released a 15-page report yesterday providing a list of recommendations to the revised labour law released by the UAE Labour Ministry last month. While Human Rights Watch, an international non-governmental organisation, welcomed the ministry’s initiative to put a draft of the revised laws on the Internet inviting public comment, it also claimed that the proposed labour law falls short of the international standards for workers’ rights.

Halliburton plans to hire 13,000 workers amid move to Dubai
Halliburton's announcement this week that its chief executive, Dave Lesar, would lead the company from a new headquarters in Dubai raised an outcry among some in the US.
Some Congressional Democrats raised fears the move would mean job cuts in the US and suspicions that Halliburton was trying to avoid paying US taxes. The firm says it will remain incorporated in Delaware and the move won't affect its tax burden.
In a memo to US employees on Tuesday, chief operating officer Andy Lane said Halliburton was girding for an expansion and hiring binge that would increase its workforce by nearly 30 per cent this year.

But according to new regulations, you cannot sponsor only one of your parents and have to sponsor your father and the mother together, with proof that you are their sole supporter and they have no one to take care of them back home.
If one of your parents has passed away or if you are divorced, you have to show papers to prove that to the Naturalisation and Residency Department, as justification why you want to sponsor only one of your parents.

Sri Lanka and UAE to sign workforce accord
Mohammad Nabavi Junaid, Sri Lankan Ambassador, said UAE Labour Minister Dr Ali Bin Abdullah Al Ka'abi will sign the MoU this month during an official visit to Colombo. The ambassador said the agreement aims to eliminate exploitation of workers by unauthorised job agents and unscrupulous recruitment agencies.
"This will streamline the recruitment and flow of Sri Lankan workforce into the UAE. The MoU will also alleviate the working conditions of workers, which include provision of proper accommodation, welfare, health, safety and guarantee all rights under the UAE Labour Law," he said.
The Labour Ministry has signed similar MoUs with India and Pakistan, and another will be signed with Bangladesh.

QR600 pay sought for Lankan janitors - Embassy presses for minimum wages
A senior mission official told The Peninsula yesterday that the cleaning companies here are notorious for paying low salaries to their employees.
A Sri Lankan janitor is on an average paid QR400 a month which is a pittance considering the escalating prices, especially of foodstuff and clothing, said Cryshantha Herath, Labour Attaché at the Sri Lankan Embassy.

Put an end to sending women abroad as house maids – President
Mr. Mahinda Rajapakse expressed these views addressing a ceremony held in connection with the awarding of appointment letters to a group of nurses.
The President added that requests have come from foreign countries for the employment of nurses. The president said that agreements have been signed to this effect and Sri Lankans would be sent for nursing and other professions. He pointed out that even though house maids brought huge amounts of foreign exchange to the country, the social problems experienced are more disastrous.
